These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Zilfire, LLC, doing business as Praevix AI ("Company", "we", "us", or "our"), concerning your access to and use of the zilfire.com and praevix.ai websites, as well as any other media form, mobile application, web widget, or text messaging service linked or connected thereto (collectively, the "Services").

By accessing our Services, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Services and must discontinue use immediately.

1. Description of AI Services & Web Chat

Praevix AI provides managed AI agents, chatbots, web widgets, and integrated systems for lead qualification, intake, customer support, and customer communications.

  • Conversational AI Nature: You acknowledge that our conversational web widgets and text bots are powered by automated algorithmic systems. While we endeavor to ensure proper process and factual accuracy through prompt engineering and knowledge base grounding, responses are probabilistic.
  • System Hardening: Any attempts to bypass system prompts, initiate prompt injection attacks, execute malicious payloads, or force our AI agents into performing off-topic or unauthorized computational tasks are strictly prohibited and will result in an immediate block of your IP address.

2. SMS Text Messaging Program Terms

By checking an SMS opt-in checkbox on our web forms or providing an explicit "YES" confirmation to a Praevix AI conversational web agent, you provide your express written consent to enroll in our text messaging program.

  • Program Mechanics: Subscribers will receive automated texts containing lead capture confirmations, project follow-ups, and appointment scheduling links. Message frequency varies based on your direct interactions with our agents.
  • User Costs: Message and data rates may apply to any texts sent or received as part of this program. We charge no premium fees for text enrollment, but your standard mobile carrier rates for data and SMS apply.
  • Stop and Help Commands: You can opt-out of receiving SMS messages at any time by texting STOP, UNSUBSCRIBE, QUIT, or STOPALL to our number. You will receive a single text confirming your removal from our active list. Text HELP at any time to receive standard support information.
  • Carrier Liability: Mobile carriers (including but not limited to AT&T, T-Mobile, and Verizon) are not liable for delayed or undelivered messages.

3. Intellectual Property Rights

Unless otherwise indicated, the Services, including all source code, databases, AI configurations, prompt architectures, software designs, website layouts, audio, video, text, and graphics (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright, trademark, and various other intellectual property rights.

4. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. Prohibited activities include, but are not limited to:

  • Circumventing, disabling, or interfering with security-related features of the Services or our API endpoints.
  • Exceeding our established rate limits (such as spamming our conversational interfaces at a rate exceeding standard manual human capabilities).
  • Using the Services to harvest or collect phone numbers, emails, or personal data of our users or clients without explicit authorization.

5. Limitation of Liability

In no event will Zilfire, LLC, its members, managers, or employees be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or loss of data arising from your use of our websites, web widgets, or text messaging programs, even if we have been advised of the possibility of such damages.

6. Governing Law

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. You expressly agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Wake County, North Carolina.
